Specific Performance
A court order compelling a breaching party to perform its contractual obligation, used when monetary damages cannot adequately remedy the breach.
What it means
Specific performance is an equitable remedy ordering the breaching party to do what it promised — typically used when the contract involves unique property (real estate, rare art, custom goods) and money cannot substitute for performance. Courts will not order specific performance for personal-service contracts (no involuntary servitude) or when supervision would be impracticable.
